Getting Divorced in Costa Rica

 

  1. By mutual consent. This, of course, requires that both parties agree on child support, child custody, dissolution of assets, etc. We believe this can actually be done without a lawyer but wouldn't try it. It may take a year or more for the courts to recognize this, PANI to approve it, etc.
  2. The judge can declare divorce by separation if the parties have been approved by the court as separated for one year, which means counting from the date of court approval of the separation. I think you have to attend counseling or reconciliation meetings or something to do this.
  3. Separation for at least three years. We are not sure how you prove this.
  4. Of course there is divorce for cause, too, but it does not sound like this applies, and is lengthy and usually difficult to prove.
